Does Your Trust Need an EIN?

EIN REQUIRED

Irrevocable Trust

Must have its own EIN. An irrevocable trust is a separate tax entity and must file its own tax return (Form 1041).

  • Cannot be modified or revoked
  • Separate tax entity from grantor
  • Files Form 1041 annually
  • Must have EIN for bank accounts

Revocable (Living) Trust

EIN needed in certain situations. While the grantor is alive, the trust can use the grantor's SSN. An EIN is required when:

  • Grantor passes away
  • Trust becomes irrevocable
  • Bank or financial institution requires it
  • Trust has income independent of grantor

Types of Trusts We Help

Living Trust

Revocable trusts that become irrevocable upon grantor's death. EIN needed for trust administration after death.

Family Trust

Trusts created to manage and transfer family wealth. Often irrevocable and require EIN from inception.

Special Needs Trust

Trusts for beneficiaries with disabilities. Typically irrevocable to protect government benefits eligibility.

Real Estate Trust

Land trusts and real estate investment trusts. EIN often required for property transactions and rental income.

Charitable Trust

Charitable remainder trusts (CRT) and charitable lead trusts (CLT). Irrevocable trusts requiring EIN.

Testamentary Trust

Trusts created by a will upon death. Always requires EIN as it only exists after grantor's death.

Why Your Trust Needs an EIN

File Form 1041

Irrevocable trusts must file Form 1041 (US Income Tax Return for Estates and Trusts) annually. An EIN is required to file.

Open Trust Bank Accounts

Banks require an EIN to open accounts in the trust's name. Essential for managing trust assets and distributions.

Hold Real Estate

When a trust holds real property, the EIN is needed for property tax records, rental income reporting, and transactions.

Issue K-1s to Beneficiaries

Trusts that distribute income to beneficiaries must issue Schedule K-1 forms showing each beneficiary's share.

Trust EIN FAQ

Does a revocable living trust need an EIN?

While the grantor is alive, a revocable trust can use the grantor's SSN. However, an EIN is required when the grantor dies (trust becomes irrevocable) or when opening accounts that require it.

What's the difference between a trust EIN and an estate EIN?

An estate EIN is for the deceased person's estate (to handle final affairs, debts, and distributions). A trust EIN is for a trust entity that may continue operating for years. They're separate entities and need separate EINs.

Can I be the grantor and trustee of my own trust?

Yes, this is common with revocable living trusts. You create the trust (grantor), manage it (trustee), and benefit from it (beneficiary). The trust still needs its own EIN for proper tax reporting once required.

How fast can I get a trust EIN?

With our service: Basic (3-5 business days), Standard (24-48 hour estimate), Express (same-day review target). Perfect for trustees who need to open bank accounts quickly.

International Trustees

Are you a trustee living outside the United States? Non-US residents can manage US trusts and get an EIN. We handle IRS phone applications for international trustees who don't have an SSN.
