Who is a "Non-US Resident"?

For EIN purposes, a non-US resident (or non-resident alien) is someone who:

  • Does not have US citizenship
  • Does not have a Green Card (permanent residency)
  • Does not meet the "substantial presence test" (183+ days in US)
  • Lives and works primarily outside the United States

Note: Even if you're on a temporary US visa (tourist, student, work visa), you may still be considered a non-resident for tax purposes. This page applies to you.

  • • File US business tax returns

Non-US Resident EIN FAQ

Can non-US residents legally get a US EIN?

Yes, absolutely. The IRS explicitly allows foreign nationals and non-US residents to obtain EINs for US business purposes. This is a standard, legal process.

Do I need to visit the United States?

No. The entire EIN application process can be completed remotely. You don't need a US visa, and you never need to physically be in the US.

What's the difference between EIN and ITIN?

An EIN is for businesses, while an ITIN is for individuals. You need an EIN for your US business entity. You may need an ITIN separately if you personally file US taxes.

Do I need to form a US company first?

Yes, you need a US legal entity (LLC or Corporation) before applying for an EIN. Popular choices are Delaware, Wyoming, and Florida. We recommend using a formation service if you haven't yet formed your entity.

Will I owe US taxes if I get an EIN?

Having an EIN doesn't automatically create a US tax obligation. Tax liability depends on your business activities, income sources, and tax treaties between the US and your country. Consult a tax professional for your specific situation.
